TERMS AND CONDITIONS OF SALE

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF SALE CAREFULLY BEFORE USING THE WEBSITE. By using the UnspoiledIslands as a SunScriber you signify your agreement to all terms, conditions and notices contained or referenced herein (the "Terms and Conditions of Sale").

1. Fares and Rates. UnspoiledIslands.com quotes all prices in U.S. dollars, which prices are subject to, change without notice at the sole discretion of UnspoiledIslands.com. The prices quoted are guaranteed once payment is received.

2. Reservations. All reservations are subject to availability. In the event circumstances beyond UnspoiledIslands.com's control develop and make changes necessary, UnspoiledIslands.com reserves the right to vary itineraries and/or inclusions or substitute hotels of similar standard. Reservations must be made at least 7 days prior to departure from the U.S.A. A special fee of $15 will be assessed to bookings that require overnight express delivery. Overnight delivery requests will be accepted up to 5 p.m. Monday through Friday, however, there will be no Saturday or Sunday deliveries. UnspoiledIslands.com encourages Subscribers to make reservations as early as possible so as to assure confirmation of selected travel components.

3. Payments and Cancellation. SunScribers should realize there is great variability on payment, posting and deposits required for travel arranged by UnspoiledIslands.com due to the different conditions imposed by Airlines, type of fare purchased, seasonality of the Resorts/Hotels accommodation rates and the lack of standardization of deposit requirements. As a result UnspoiledIslands.com deposit requirements vary, and are dependent on the policies of the providers that we arrange on your behalf. UnspoiledIslands.com has established a minimum deposit for reserving any accommodations, however, this standard must be altered whenever a reservation is made with a property that has a more stringent policy.

a. UnspoiledIslands.com Minimum Deposit Requirement for Accommodations: UnspoiledIslands.com requires a 3-day deposit that is fully refundable up to 30 days before departure. This deposit is posted to a major credit card, and will be refunded in full if the reservation is cancelled within 30 calendar days prior to the reservation.

The deposit is posted as a credit on your resort account at the time of check-in or checkout. UnspoiledIslands.com will provide a voucher two weeks prior to departure, via email, for use in confirming with the property that a credit has been processed.

b. UnspoiledIslands.com Deposit Requirement for Airlines: The Airlines deposit requirements, and refund policies, vary greatly due to the class of ticket purchased. Due to the ticketing process that UnspoiledIslands.com is using, the charge for this transaction is posted to a travel agent entity named World Travel, and/or will note the Airline carrier as well. This process varies depending on the various payment processing systems utilized by the carriers we will utilize.

c. UnspoiledIslands.com Deposit Requirements for Tour Operators and Ground Transfers: UnspoiledIslands.com will engage the service of a tour provider and/or ground transportation providers as part of either a package reservation or a specific Resort/Hotel reservation. UnspoiledIslands.com requires payment in full for these third party arrangements 30 days prior to departure. This payment in full is posted to a major credit card and refunded in full if canceled 30 days before departure. Any cancellation made 15-29 calendar days prior to departure will result in a credit of 50% of the payment. Any cancellation 14 days or less, prior to departure, will cause the payment to be forfeited.

UnspoiledIslands.com is advancing these funds to the on island providers of these services to guarantee your arrangements, and must relinquish these funds to cover the loss of business for these operators.

Please be advised that UnspoiledIslands.com grants no refunds for lost or stolen documents. In addition, some "stand alone" travel components which are cancelled and returned unused within 6 months from the date of issue, i.e., rail tickets, hotel vouchers, special cruises etc, have unique cancellation policies which will be stated at the time of booking. Rail reservations are totally non-refundable.

4. Hotels. Hotel rates found on this website include (unless otherwise stated): accommodations with private bath and shower, continental breakfast, hotel taxes and general service charges. Local municipal city taxes may be additional in some locations and must be paid separately by the SunScriber. Hotel rates do not include any expenses of a personal nature. Room assignments are at the discretion of the hotel operator and specific requests cannot be guaranteed.

5. Check-In. UnspoiledIslands.com cannot guarantee check-in prior to 2:00 p.m. departure is normally required by 11:00 a.m.

6. Car Rental. Car rental agencies require that the minimum driver's age is 25 years old and in some circumstances car rental company rules impose a maximum age limitation. Basic car rental rates include: unlimited mileage and VAT (value added tax) where applicable. Car rental rates do not include: tolls, gasoline, third driver surcharge and overtime charges. Specific car models cannot be guaranteed. Finally, airport surcharges and/or one-way drop-off fees may apply.

7. Insurance. UnspoiledIslands.com does not insure your trip. UnspoiledIslands.com strongly urges SunScribers and participants to obtain separate baggage, trip cancellation or interruption and personal accident insurance coverage.

8. Passport and Visa. The SunScriber and participants must obtain their own passports and visas. UnspoiledIslands.com is not responsible for providing passports or visas. SunScriber's should consult the appropriate consulate to obtain visa information.

9. Airfares. The airfares and schedules are based on regularly scheduled service. All applicable airline rules apply. All airline schedules are subject to change. Basic quoted airfares do not include the following: airport departure taxes, passenger facility charges (PFC's), customs and immigration fees or excess baggage charges.

10. Delivery of Travel Documents. UnspoiledIslands.com will deliver travel documents via UPS, 24 hours after full payment. UnspoiledIslands.com is not responsible for lost or stolen documents, therefore, any re-issuance of documents may be assessed their full face value.

11. Refunds for Unutilized Travel. NO REFUND CLAIM WILL BE CONSIDERED OR PURSUED AND NO ACTION WILL BE TAKEN BY UNSPOILEDISLANDS.COM UNLESS NOTICE OF CLAIM IS RECEIVED WITH SUPPORTING DOCUMENTATION WITHIN 30 DAYS OF COMPLETION OF TRAVEL. NO REFUNDS WILL BE GRANTED FOR UNUSED LAND ARRANGEMENTS ONCE THE TRIP HAS BEEN COMMENCED. ALL DOCUMENTS MUST BE RETURNED TO UNSPOILEDISLANDS.COM IN ORDER FOR A REFUND REQUEST TO BE CONSIDERED. IT IS STRONGLY RECOMMENDED THAT YOU USE CERTIFIED MAIL WHEN RETURNING DOCUMENTS TO UNSPOILEDISLANDS.COM SINCE MANY COMPONENTS MAY BE NON-REFUNDABLE IF LOST OR STOLEN. REFUND DECISIONS ARE DETERMINED BY UNSPOILEDISLANDS.COM PER THE SIGNED AGREEMENT BETWEEN UNSPOILEDISLANDS.COM AND THE SUPPLIER(S). NO REFUND DETERMINATION DECISION CAN BE MADE BY ANYONE OTHER THAN UNSPOILEDISLANDS.COM.

12. Responsibility of SunScriber. UnspoiledIslands.com and its directors, officers, employees, independent contractors and agents act exclusively as agents for the SunScriber (passenger) in making arrangements for hotels, transportation, sightseeing, sports, excursions, restaurants and other services described and set forth in this website. The SunScriber or individual tour participant by accepting the tour documents agrees that UnspoiledIslands.com and it directors, officers, employees, independent contractors, agents or suppliers shall not be liable for any injury, damage, loss, accident, delay, irregularity, liability and/or expense to person or property due to any act or default of any hotel, transportation provider, restaurant, company or person providing or rendering any of the services included in the tour(s). The tickets, coupons, tariffs, rules or contracts currently in use by any transportation provider, hotel, restaurant, or any other contractor providing service shall constitute the sole contract between the contractor and the SunScriber or tour participant. UnspoiledIslands.com and its directors, officers, employees, independent contractors, agents and suppliers accept no responsibility for any damage, delay, irregularity, expense or liability arising from sickness, pilferage, labor dispute, machinery breakdown, quarantine, government restraints, war, act of terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure, causality or other cause. Any and all losses and expenses will be borne by the SunScriber or tour participant. The tour rates are strictly applicable to the time period and places specified. All accommodations, services and facilities are subject to the laws of the countries in which these accommodations, services or facilities are provided.

Right to Change. UnspoiledIslands.com reserves the right to cancel or change itineraries and substitute services without notice, and to decline to accept or retain any SunScriber or tour participant at any time.
