9. Choice of Law and Forum. These Terms of Use shall be governed and construed in accordance with the laws of the state of Delaware, excluding conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or dispute with UnspoiledIslands.com arising from or related to these Terms of Use or your use of the site resides in the state and federal courts of the state of Maryland, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

None of the arbitrators shall be officers or employees of the parties to these Terms of Use. Such arbitrators shall be experts in the computer/information technology field. The cost of arbitration, including fees per arbitrator, shall be borne equally by the parties. The location of the arbitration shall be Washington, D.C., U.S.A.
